The Montana Department of Administration (DOA) announced a leadership change at the Office of Public Defender (OPD) today, naming Koan Mercer as the agency’s new director. Mercer will replace Brett Schandelson, who is stepping down after nearly eight years with the office.
“Schandelson’s work during his time at OPD was highly impactful and effective,” DOA Director Misty Ann Giles said. “We look forward to the skill set Mr. Mercer will bring to this role, while having continued assurance that all Montanans’ constitutional right to counsel will be protected as we work with him in the future.”
Governor Greg Gianforte thanked Schandelson for his years of service. “Thanks to the dedication of the OPD team and under Brett’s leadership, the office was able to build lasting systems for better public defense in Montana,” Gianforte said. “I am grateful for Brett’s eight years of service to the state and look forward to Mercer filling the role to continue as a strong defender of the constitutional rights of Montanans.”
Schandelson joined OPD in 2017 as Development and Operations Bureau Chief and became director in 2022. In October 2025, the DOA announced his decision to leave the position to pursue new opportunities.
Mercer earned his law degree from the University of North Carolina in 2004 and joined OPD in 2006. Most recently, he served as the agency’s central services division administrator.
“OPD is grateful for Brett’s leadership and service,” Mercer said. “I’m excited to continue the vital work of OPD and look forward to serving the people of Montana in this important role.”
Mercer is scheduled to begin his tenure as OPD Director on January 12, 2025.
